TERMS AND CONDITIONS OF ALL ACCOR BUSINESS: PILOT PHASE

1. PROGRAMME DESCRIPTION

ALL Accor Business by ALL Accor (the “ALL Accor Business programme”) is a specialised programme developed by Accor, designed to meet the travel needs of participating small to medium-sized enterprises (“SMEs”). The ALL Accor Business programme enables SMEs and employees to seamlessly book corporate travel with a discounted rate on the public rates, earn ALL Accor Reward Points (“Reward Points”), and have access to exclusive services and loyalty benefits in participating hotels.
 

These Terms and Conditions govern a limited test phase of the ALL Accor Business programme: the Pilot Phase (“Pilot Phase”) is conducted for testing, evaluation and feedback purposes only and is not intended to represent the final version of the ALL Accor Business programme. Participation in this Pilot Phase does not guarantee that the ALL Accor Business programme will continue, expand, or become available more widely in the future.
 

The ALL Accor Business programme is being progressively developed and deployed. As part of this ongoing evolution, specific features, benefits, services and applicable Terms and Conditions may be developed over time in line with the advancement of the ALL Accor Business programme launch. Accor reserves the right, at its sole discretion, to amend or update these Terms and Conditions as the ALL Accor Business programme evolves, and to modify, suspend or terminate the Pilot Phase, at any time. Accor will inform participating SMEs of any suspension or termination of the Pilot Phase.

Individual travelers employed by the SMEs (“Business Travelers”) are bound by the full set Terms and Conditions of Membership of ALL Accor programme (“ALL Accor Membership T&Cs”), customer personal data protection charter, and general terms and conditions of services, as applicable.


 

2. ELIGIBILITY

  1. Participation in the ALL Accor Business programme is available exclusively to Business Travelers already enrolled in the ALL Accor programme and employees of a SME enrolled in ALL Accor Business programme.

  2. Only Business Travelers already enrolled in the ALL Accor programme are eligible to participate in travel benefits provided to Business Travelers by ALL Accor Business programme.

  3. Eligibility of a Business Traveler to participate in the ALL Accor Business programme is subject to the SME's sole and absolute discretion. Notwithstanding the foregoing, Accor reserves the right, at any time and without prior notice or compensation, to suspend or terminate a Business Traveler’s participation in the ALL Accor Business programme in the event of:
    a)    a breach of the present Business Traveler Terms and Conditions or the ALL Accor Membership Terms and Conditions;
    b)    fraudulent use of the card or Reward Points;
    c)    communication of falsified information and/or;
    d)    detrimental or objectionable behavior by the Business Traveler or anyone accompanying them, including but not limited to regrettable, malicious or insulting behavior towards hotel staff, customers, customer service personnel, or any other person related to the services, benefits or advantages offered by the hotels or by Accor, including during events organised as part of the programme.

    Such suspension or termination may result in the cancellation of any Reward Points earned by the Business Traveler, in accordance with Article 12 of the ALL Accor Membership Terms and Conditions. This suspension or termination shall be without prejudice to Accor's right to take any further action against the Business Traveler.

  4. Business Travelers member are subject to the ALL Accor Membership Terms and Conditions. Participation in the programme is unauthorised in any jurisdiction where ALL Accor programme or any portion of ALL Accor Business programme may violate any legal requirements. 


     

3. ENROLLMENT & RESPONSIBILITIES

  1. For the purposes of the ALL Accor Business programme, notice by Accor that the individual duly authorised by the SME to manage the Company Account (“the Administrator”), at the contact information provided by such Administrator shall constitute sufficient notice to Business Travelers.

  2. Accor is not responsible for any actions taken by the Administrator nor by anyone using an ALL Accor member’s number on behalf of, or purportedly on behalf of, the Business Traveler. 

  3. Business Travelers acknowledge and agree that the Administrator of their SME has certain account management permissions that may directly affect them, including the ability to:
    a)    Invite Business Travelers to enroll to the Company Account: Invite any Business Travelers to the programme by sharing an email link, digital invite. The link is valid for a period of one (1) month from the date of issuance. After this period, the link will expire and will no longer be accessible. Keep in mind, Business Traveler must enroll or be enrolled in ALL Accor programme and have a professional email address with the same emails domains as the SME;
    b)    Manage access to the Company Account: Assign or modify Business Travelers roles and permissions within the Company Account, and add, update or revoke any Business Traveler roles within the Company Account;
    c)    Upload or delete the SME’s Travel Policy: manage all related parameters;
    d)    Consult Business Travelers’ professional bookings.

  4. Once the Business Traveler has been enrolled in ALL Accor Business programme, their participation remains valid as long as they are linked to an active Company Account, unless earlier terminated in accordance with the applicable Terms and Conditions. The Business Traveler will receive a verification email after one (1) year to confirm that they are still employed by the SME and remain eligible for the programme. The Business Traveler will have a period of one (1) month from the date of such notification to complete the verification. Reminder communications may be sent during this period. If the Business Traveler fails to complete the verification within the required timeframe, their account will be unlinked from the Company Account.

  5. The ALL Accor Member Account of the Business Traveler will be linked to the Company Account for the purposes of the ALL Accor Business programme.

  6. The Administrator must remove any Business Travelers from the ALL Accor Business programme at any time, and without undue delay, when they are no longer part of the SME. The Administrator must ensure that the Business Traveler’s account is unlinked from the Company Loyalty Account when they leave the SME.


     

 

4. BUSINESS TRAVELER ROLE & RESPONSIBILITIES

  1. Each Business Traveler must enroll themselves using the enrollment link provided by the Administrator. The Business Travelers must have email addresses that match the company work emails domains, for example, name@company.com. Accor will not be able to accept generic emails, such as Gmail or Yahoo emails domains.

  2. Business Travelers enrolled will also receive a verification email to confirm their continued employment within the SME and thus their link to its Company Account as defined below. Business Travelers are required to click the confirmation link in the email to confirm. If Business Travelers fail to validate their eligibility, their membership in the ALL Accor Business programme will automatically unlink the Business Traveler from the Company Account.

  3. Any errors or omissions relating to the crediting of Reward Points under the ALL Accor Business Loyalty programme must be reported in writing to Accor no earlier than seven (7) days following the check-out date and no later than six (6) months from such date, in accordance with the ALL Accor Loyalty programme Terms and Conditions. Claims submitted before or after this period will not be accepted. Claims relating to matters other than the crediting of Reward Points may be submitted immediately following the stay and must be submitted no later than six (6) months from the check-out date. All claims must be submitted by email to allaccorbusiness.care@accor.com during the Pilot Phase. 


     

5. ALL ACCOR BUSINESS BENEFITS FOR BUSINESS TRAVELERS

  1. ALL Accor Business programme offers various benefits (the “Benefits”) to Business Travelers, including the benefits available under ALL Accor Loyalty programme, and specific benefits exclusively offered under the ALL Accor Business programme, including exclusive discounts, Reward Points, and loyalty benefits as described below:
    a)    Exclusive discount on stays: ALL Accor Business programme offers an “All Accor Business Rate” providing up to ten percent (10%) discount on the public rate when bookings are made exclusively through Accor direct distribution channels, namely Accor websites, ALL Accor application, Accor reservation call centers, and participating Accor Hotels (the “Direct channels”). The ALL Accor Business Rate is a yieldable rate. Planning (OPEN/CLOSE/MINSTAY) may be managed at participating hotel discretion, and for IDEAS hotels with Bid Price optimization will be handled via the Last Room Value (LRV). The Accor Business Offer Discounted Rates shall be subject to availability through the agreed-upon Booking Channels. Stays booked under this rate shall be eligible to earn Reward Points on the Company Account within the ALL Accor Business programme. This discount applies only to the qualifying rate and does not apply to applicable taxes, fees (including but not limited to resort fees), gratuities, service charges, or incidental charges. During Pilot Phase, any other stays booked with a different rate shall not be eligible to earn Reward Points on the Company Account;

    b)    Reward Points earned on business stays: Reward Points may be earned, at Business Travelers level, on the Member Account for each business stays booked with the eligible “All Accor Business rate”. The validity and expiration of Reward Points are governed by the ALL Accor Terms and Conditions of Membership (See 7. EARNING ALL ACCOR POINTS, Paragraph 7.1). The earning rate is one euro (€1) spent on an eligible business stay = one (1) Reward Point.  The earning of Reward Points is subject to the ALL Accor Loyalty programme Terms and Conditions, including limitations on the number of rooms eligible to earn points and specific conditions applicable to group bookings or events. Reward Points are awarded based on eligible spend, excluding applicable taxes and non-eligible charges. Where transactions are made in a currency other than Euro, amounts may be converted into Euro in accordance with Accor’s applicable rules, as defined in the ALL Accor Loyalty programme Terms and Conditions. For the avoidance of doubt, Reward Points earned under the ALL Accor Business programme in respect of an eligible business stay shall not be cumulative with any Reward Points that would otherwise be earned under the ALL Accor loyalty programme for the same stay. Each eligible business stay shall give rise to a single earning of Reward Points, credited in accordance with the terms of the ALL Accor Business programme as set out herein.
    For the purposes of ALL Accor Business programme, “Eligible Spend” is considered as room rates paid for stays where a Business Traveler:
        -    Is the registered guest;
        -    Bookings are made exclusively through Accor direct distribution channels, namely Accor websites, ALL Accor application, Accor reservation centers, and participating Accor Hotels (the “Direct channels”) under the “ALL Accor Business rate” use in participating properties;
        -    Provided an ALL Accor number at check-in or check-out;
    The registered guest whose name appears on the reservation must be an ALL Accor Business Traveler in good standing. Spend is not Eligible Spend if it is:
        -    On any rate that is not a qualifying rate;
        -    For stays where no ALL Accor membership number is provided at the time of check-in or check-out or where the ALL Accor membership number used is not linked with an ALL Accor Business Company Account;
    In addition, spend on products or services other than room rate, including without limitation resort/destination fees, additional cleaning fees, spa, food, beverage and lounge expenditures, laundry or dry-cleaning charges, telephone fees, membership fees, and amounts paid to a third party, and taxes do not count as Eligible Spend. 

  2. These benefits can vary based on the sole discretion of the applicable participating property and will be communicated prior to or at the time of booking. Participating properties may adjust the applicable benefits at any time for any reason. Reservations are subject to availability at the applicable participating property, the benefit may not always be available, and participating property may allocate limited inventory to the Benefits.

  3. The benefits only apply to qualifying eligible stays that a Business Traveler has planned, actualised, and paid for in full during ALL Accor Business. The benefits will be applied during the ALL Accor Business Term for new qualifying stays booked once the Company Account has been created only. The benefits will not be retroactively applied for previously booked or held stays or for stays that were booked or held prior to a member’s enrollment in ALL Accor Business. Qualifying stays booked before the ALL Accor Business Term or booked after the ALL Accor Business Term will not be eligible to these benefits.

  4.  A participating property may require that a Business Traveler verify their identity at check-in and confirm that they are the holder of an  ALL Accor membership account.

  5.  Accor can correct, modify, or rescind any benefits applied to a Member in error and/or not legitimately earned in accordance with these terms.


     

6. TERMINATION OF MEMBERSHIP

  1. If the Company Account is voluntarily terminated by the Administrator, the termination shall be irreversible. Upon closure of the Company Account, all benefits provided under the ALL Accor Business programme, including benefits applicable to Business Travelers, will be forfeited. A new account may be created in accordance with the applicable Terms and Conditions.

  2. Accor may immediately, without notice, limit or terminate the Company Account if, in its sole discretion. In such cases, Business Travelers linked to the Company Account will lose all the benefits associated with the Company Account. Accor reserves the right to suspend or terminate the participation of any Business Travelers who violate these Terms and Conditions, including in the following cases:
    i.        Violates these T&Cs – ALL Accor Business programme or any other applicable additional terms or appears to be utilising ALL Accor Business in a manner inconsistent with these T&Cs – ALL Accor Business programme or the intent of ALL Accor Business;
    ii.        Fails to promptly pay business bills or books stays or other qualifying activity for which bills are not promptly paid;
    iii.       Is suspected or found to be acting in an abusive or fraudulent manner or engaging in any conduct that artificially, improperly, or deceptively impacts the accumulation, use, or loss of benefits;
    iv.       Attempts to transfer its account or benefit or awards to another Member or a third party, except as expressly permitted by these Terms or by Accor;
    v.       Makes any misrepresentation in connection with ALL Accor Business programme;
    vi.      Impairs the normal functioning of the ALL Accor Website;
    vii.     Disturbs other guests or otherwise disrupt or impair the normal operation of Accor or any Participating Property;
    viii.    Acts in a manner detrimental to Accor, an Accor employee or colleague, other Member, or any third party (including without limitation behaving towards any Accor employee or colleague or Accor guest in any manner that is abusive, harassing, threatening, derogatory, disrespectful, lewd, obscene, offensive, or otherwise inappropriate, ALL as determined by Accor in its sole discretion);
    ix.      Acts in any manner that is inconsistent with local, state, provincial, national, or federal laws, regulations, orders, or other rules.


     

7. PERSONAL DATA

  1. In the context of the ALL Accor Business programme, the Business Traveler acknowledges that Accor SA and the SME act as separate data controllers when processing the personal data.

  2. Accor SA processes personal data for the purposes of operating the ALL Accor loyalty programme, in accordance with the Terms and Conditions of Membership and as described in its Personal Data Protection Charter.

  3. The SME processes personal data independently, in its capacity as employer, for its own internal purposes.


     

8. DATA BASE

  1. The personal information provided in connection with the ALL Accor Business programme is maintained in a database that is owned and/or controlled by Accor. 


     

9. ACCEPTANCE OF TERMS AND SETTLEMENT OF LITIGATION AND APPLICABLE LAW

  1. Interpretation of these T&Cs – ALL Accor Business programme shall be at the sole discretion of Accor. Accor reserves the right to add, modify, restrict, suspend, discontinue, delete, or otherwise change these T&Cs – ALL Accor Business programme or any rules related to the programme at its sole discretion, with or without notice at any time subject to local laws or regulations.

  2. If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions hereof, which shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent and economic effect of the provision so replaced. 

  3. For Pilot Phase, T&Cs can evolve with new functionalities being added to the offer. In case of questions, claims or litigation during the Pilot Phase, participating Business Travelers may benefit from dedicated support provided by ALL Accor’s Care team at the following email address: allaccorbusiness.care@accor.com.

  4.  By clicking on the check box, Business Traveler confirms that they have read, understood, and accepted these Terms and Conditions set forth above, including the Accor Privacy Statement.

  5. If the Member brings the dispute relating to the ALL Accor Business programme, the member must contact Accor in writing at allaccorbusiness.care@accor.com in an amicable attempt to settle the matter. The dispute resolution procedure is governed by the applicable Terms and Conditions of membership.

  6. The Terms and Conditions of the ALL Accor Business programme are governed by French law.
